Acceptance of Terms

By accessing or using any service provided by OBIC Tech, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service and any additional terms contained in an approved quotation, proposal, invoice, service agreement, subscription plan, or other written arrangement between you and OBIC Tech.

If you are using our services on behalf of a business, company, NGO, school, institution, or other organization, you represent that you have authority to accept these Terms on behalf of that organization.

Our Services

OBIC Tech provides technology and digital services that may include website design and development, web applications, software development, SaaS platforms, cloud solutions, hosting, domain-related services, maintenance, cybersecurity, technical support, digital solutions, and related services.

The exact scope of a service may be defined through a separate proposal, quotation, service package, subscription, statement of work, invoice, or written agreement.

We may modify, improve, replace, or discontinue certain features of our services where reasonably necessary for technical, operational, commercial, or security reasons.

Client Responsibilities

Customers are responsible for providing accurate and complete information required for the delivery of services and for cooperating reasonably with OBIC Tech during development, implementation, maintenance, and support.

Customers are also responsible for:

• Providing content, images, logos, data, credentials, and approvals required to complete agreed work.
• Ensuring that materials supplied to OBIC Tech do not infringe third-party intellectual property or legal rights.
• Maintaining the confidentiality of account usernames, passwords, and other access credentials.
• Using our services only for lawful and authorized purposes.
• Maintaining appropriate backups where the applicable service package does not expressly include managed backups.
• Reviewing completed work and communicating requested changes within agreed review periods.

Payments and Billing

Fees for OBIC Tech services are determined by the applicable quotation, proposal, invoice, subscription package, or service agreement.

Unless otherwise agreed in writing, payments must be made within the time stated on the relevant invoice or commercial arrangement.

Certain services may require advance payment, recurring subscription payments, annual renewal fees, hosting charges, domain fees, licensing fees, or other recurring charges.

Failure to pay outstanding amounts may result in suspension, restriction, or termination of the affected service after reasonable notice where appropriate.

Subscriptions and Renewals

Where a service is offered on a monthly, annual, or other recurring subscription basis, the service will continue for the applicable subscription period unless cancelled in accordance with the relevant service arrangement.

Renewal fees may include charges imposed by third-party providers, including hosting companies, cloud providers, software vendors, domain registrars, licensing providers, or other infrastructure partners.

Customers are responsible for ensuring that renewal payments are made before applicable expiration dates to avoid service disruption.

Website Development and Project Delivery

Website, software, and custom-development projects may involve agreed milestones, review periods, revisions, testing, and deployment stages.

Delivery timelines may depend on timely receipt of content, approvals, credentials, technical information, and other materials from the customer.

Delays caused by missing information, delayed approvals, third-party platforms, external service providers, or requests outside the originally agreed scope may affect delivery schedules.

Hosting and Cloud Services

Hosting and cloud services may depend on third-party data centers, server infrastructure, networking providers, software vendors, domain registrars, and other technology partners.

While OBIC Tech takes reasonable steps to maintain reliable services, uninterrupted or error-free availability cannot be guaranteed.

Temporary interruptions may occur because of maintenance, security incidents, software updates, hardware failures, network issues, attacks, third-party outages, or circumstances outside our reasonable control.

Acceptable Use

You may not use OBIC Tech services for unlawful, abusive, fraudulent, harmful, or unauthorized activities.

Prohibited use may include:

• Distributing malware, ransomware, viruses, or malicious code.
• Attempting unauthorized access to servers, networks, applications, or user accounts.
• Sending spam or conducting fraudulent or deceptive communications.
• Hosting or distributing unlawful content.
• Infringing copyrights, trademarks, privacy rights, or other intellectual property rights.
• Using excessive resources in a manner that materially affects infrastructure or other customers.

OBIC Tech reserves the right to suspend services reasonably believed to create a security, legal, operational, or reputational risk.

Intellectual Property

OBIC Tech retains ownership of its pre-existing software, frameworks, code libraries, systems, methodologies, tools, templates, platforms, designs, documentation, and other intellectual property unless otherwise expressly agreed in writing.

Ownership or licensing of custom-developed work will be governed by the applicable proposal, project agreement, invoice, or written arrangement.

Third-party software, plugins, themes, APIs, fonts, libraries, hosting systems, and licensed tools remain subject to the terms and licenses of their respective providers.

Third-Party Services

Our services may integrate with or rely on third-party platforms such as domain registrars, payment gateways, cloud infrastructure providers, hosting providers, analytics platforms, social networks, email platforms, software vendors, and APIs.

OBIC Tech does not control these independent third-party services and is not responsible for interruptions, policy changes, pricing changes, account restrictions, security incidents, or other actions attributable solely to such providers.

Data and Privacy

Personal information handled through our website and services is subject to our Privacy Policy and any applicable contractual arrangements.

Customers using OBIC Tech software or hosting services to collect information from their own users remain responsible for ensuring that their collection and processing activities comply with applicable privacy and data protection laws.

Backups and Data Loss

Where backup services are included in a customer's package, OBIC Tech will use reasonable efforts to maintain backups in accordance with the applicable service arrangement.

However, customers should maintain independent copies of critical information wherever reasonably possible.

OBIC Tech cannot guarantee recovery of every file, database, email, website, or other item following deletion, corruption, compromise, hardware failure, or other unexpected events.

Security

OBIC Tech implements reasonable technical and operational measures intended to protect systems and services from unauthorized access, malware, abuse, and other cybersecurity risks.

Customers must also take reasonable precautions, including maintaining strong passwords, restricting unnecessary account access, updating software where applicable, and promptly notifying OBIC Tech of suspected compromises.

Service Suspension or Termination

OBIC Tech may suspend or terminate access to a service where reasonably necessary because of non-payment, unlawful use, security threats, abusive activity, material breach of these Terms, or other serious violations of an applicable service agreement.

Customers may terminate services according to the cancellation requirements stated in the relevant subscription, proposal, agreement, or service package.

Disclaimer of Warranties

OBIC Tech provides its services using reasonable professional skill and care. However, except where expressly stated in a written agreement, services are provided without guarantees that they will always be uninterrupted, completely error-free, or suitable for every particular commercial purpose.

Results from websites, digital marketing, software, optimization, hosting, search visibility, analytics, or other technology services may be affected by third-party platforms, user behavior, market conditions, search engines, algorithms, infrastructure, and factors outside OBIC Tech's control.

Limitation of Liability

To the extent permitted by applicable law, OBIC Tech will not be responsible for indirect, incidental, consequential, special, or punitive losses arising from the use or inability to use our services.

This may include loss of profits, revenue, business opportunities, goodwill, or data where such loss results from events outside our reasonable control or from the customer's own actions, systems, content, credentials, or third-party providers.

Changes to These Terms

OBIC Tech may update these Terms of Service from time to time to reflect changes in our services, technology, legal requirements, commercial practices, or security procedures.

The most recent version will be published on this page with an updated "Last Updated" date.

Governing Terms

These Terms should be read together with any specific proposal, quotation, invoice, service-level agreement, subscription terms, or written contract applicable to the service you purchase from OBIC Tech.

Where a separately signed agreement contains terms that conflict with these general Terms of Service, the specific written agreement will govern to the extent of that conflict.
